Parecer Jurídico Sobre Símbolos Nacionais E Cores Do Uniforme Da Seleção Brasileira

Resumo O parecer analisa a possibilidade jurídica e constitucional da Seleção Brasileira de Futebol utilizar uma camisa vermelha, distinta das cores tradicionalmente associadas à bandeira nacional. Com base na Constituição Federal, na Lei nº 5.700/1971 e em jurisprudências relevantes (STJ e TRF-5), conclui-se que a camisa da seleção não é um símbolo nacional oficial protegido pela Constituição. Assim, não há vedação legal expressa que impeça a adoção de uma nova cor de uniforme, desde que não haja desrespeito direto aos símbolos oficiais da República. Eventuais críticas à mudança são de natureza cultural e política, mas não configuram ilegalidade ou inconstitucionalidade. O parecer também menciona projetos de lei recentes que, se aprovados, poderão alterar esse cenário no futuro. Abstract The legal opinion examines the constitutional and legal feasibility of the Brazilian National Football Team adopting a red jersey, diverging from the traditional colors associated with the national flag. Based on the Federal Constitution, Law nº 5.700/1971, and relevant case law (from the STJ and TRF-5), it is concluded that the team’s jersey is not an official national symbol protected by the Constitution. Therefore, there is no explicit legal prohibition against adopting a new uniform color, provided that there is no direct disrespect toward the official symbols of the Republic. Any criticism regarding the color change is cultural and political in nature but does not constitute illegality or unconstitutionality. The opinion also notes recent legislative proposals that, if enacted, could modify this legal framework in the future.
